Terms of Service

These terms are the agreement between you and Test Prep for use of the test-preparation service at www.testprep.college. Please read the sections on eligibility, subscriptions, and limits of liability closely — they affect your rights.
1. Agreement
By creating an account or using Test Prep (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms take effect September 4, 2026.
2. Who may use the Service
You must be at least 13 years old to hold an account. The Service is intended for users in the United States.
If you are under 18, a parent or legal guardian must read and agree to these terms on your behalf before you use the Service. That parent or guardian is the party contracting with us, is responsible for any subscription and any charges, and is responsible for your use of the Service. By allowing a minor to use the Service, a parent or guardian accepts these terms for both of you.
3. Accounts
Accounts are created through Google sign-in. You agree to provide accurate information, to keep your Google account secure, and not to share your account or let anyone else use it. You are responsible for activity under your account. Tell us promptly at support@testprep.college if you believe your account has been accessed without your permission.
Access is currently invite-only. We may decline to create an account, or limit access, at our discretion.
4. Linked parent, guardian, and tutor access
A student may invite a parent, guardian, or tutor to view their progress. Linked access requires an invitation that is sent and then accepted; no one gains access by asserting a relationship. A linked adult can see practice progress, answers, scores, time spent, and skill mastery for the student who invited them, and nothing more.
A student, or a guardian acting for a student, may revoke a link at any time. Tutors are independent of us: we do not employ, verify, supervise, or vet them, we are not party to any arrangement between a tutor and a family, and we are not responsible for a tutor’s conduct. Anyone inviting a tutor should satisfy themselves as to who they are.
5. Subscriptions, billing, and automatic renewal
Some features require a paid subscription. When paid subscriptions are offered, the following applies.
- The subscription costs $7.99 per month plus any applicable tax.
- It renews automatically every month until you cancel. Your payment method will be charged at the start of each billing period without further action by you.
- You may cancel at any time from your account settings. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then.
- One subscription covers one student account and every test path we offer at the time.
- Payments are processed by Stripe under its own terms. We do not receive or store your card number.
- Promotional codes may carry their own limits, expiry, and eligibility rules, and may be withdrawn at any time before redemption.
- We may change the price. We will give at least 30 days’ notice by email before a change applies to your renewals, and you may cancel before it takes effect.
6. Refunds
If you are not satisfied, write to us within 7 days of a charge and we will refund that charge in full. After 7 days, payments are non-refundable and cancellation stops future charges rather than refunding past ones. If a subscription was purchased by a minor without the account-holder’s permission, tell us and we will refund it.
7. Acceptable use
You agree not to:
- Copy, scrape, bulk-download, republish, or resell our questions, explanations, or tutorials
- Share an account, or use one account for more than one student
- Access the Service by automated means, or attempt to circumvent rate limits, usage caps, or access controls
- Reverse engineer the Service, or probe it for vulnerabilities without our written permission
- Interfere with the Service’s operation, or with other users’ use of it
- Upload unlawful content, or use the Service to harass, endanger, or exploit anyone — particularly any minor
8. Our content, and yours
The Service, including its question bank, explanations, diagrams, software, and design, belongs to Test Prep or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use it for your own test preparation. Nothing else is granted.
What you submit — your answers and profile information — remains yours. You grant us the licence needed to operate the Service: to store your work, compute your progress from it, show it to adults you have linked, and improve the Service using information that has been aggregated so that it no longer identifies you.
9. Not affiliated with the test makers
SAT® is a trademark registered by the College Board. ACT® is a trademark registered by ACT, Inc. Neither organisation is affiliated with, sponsors, endorses, or has reviewed this Service, and our use of those names is solely to identify the examinations our material prepares you for. Our questions are our own, written to resemble the format and difficulty of those examinations. They are not actual past examination questions.
10. No guarantee of results
We do not guarantee any score, any score improvement, any admission outcome, or any particular result. Projected scores, percentile estimates, and mastery levels shown in the Service are statistical estimates derived from your practice, not predictions of your actual examination performance. Admissions statistics for colleges come from public U.S. Department of Education data and are provided for reference only.
Explanations and tutorials are generated in part by artificial intelligence and may contain errors. Verify anything you intend to rely on.
11. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these terms, if your use threatens the security or availability of the Service, or if we are required to by law. We may also discontinue the Service, in which case we will give reasonable notice and refund any period already paid for.
12. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content within it is accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Test Prep will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of or inability to use the Service, whatever the theory of liability.
Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars ($100). Some jurisdictions do not allow these limits, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
14. Indemnification
You agree to indemnify and hold Test Prepharmless from claims, losses, and reasonable legal costs arising from your breach of these terms or your misuse of the Service. If you are a parent or guardian accepting these terms for a minor, this applies to that minor’s use as well.
15. Governing law and venue
These terms and any dispute arising from them are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. You and Test Prep agree to the exclusive jurisdiction of the state or federal courts located in Richland County, South Carolina, and each of us consents to personal jurisdiction there.
16. Resolving disputes
Before filing anything, please write to us at support@testprep.college and give us 30 days to resolve the matter. Most problems, especially billing ones, are settled faster this way. Either of us may seek injunctive relief in court at any time to protect intellectual property or prevent misuse of the Service.
17. Changes to these terms
We may update these terms. If a change is material we will give notice by email or in the application at least 30 days before it takes effect, and continuing to use the Service after that date means you accept the updated terms. If you do not accept them, cancel and close your account.
18. General
These terms, together with our Privacy Policy, are the entire agreement between us about the Service. If a provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
